The US appeals court for the Fifth Circuit, which includes Louisiana, has cited definitions of gross negligence such as “wilful, wanton and reckless conduct that falls between intent to do wrong and ordinary negligence”, the “want of even slight care and diligence”, or the “utter disregard of the dictates of prudence, amounting to complete neglect of the rights of others”. The appeals court has said: “Mere inadvertence or honest mistake does not amount to gross negligence.”
