Films For Action, Inc. (“FFA,” “we,” or “us”) operates the platform and community at FilmsForAction.org and the Films For Action applications for iOS and Android (together, the “Service”). By using the Service, you agree to these Terms of Service and our Privacy Policy.


YOUR ACCOUNT

You are responsible for keeping your account secure and for all activity that occurs under it. If you become aware of any unauthorized use of your account, please notify us immediately.

Account Privacy

User profiles on Films For Action are not indexed by search engines. Your profile is accessible only to visitors browsing the Site directly.

Account Deactivation and Deletion

Both options are available at the bottom of your account settings, and they do different things.

Deactivation hides your profile so it is no longer accessible on the Service or the internet, and takes your name off content you submitted, which remains on the Service attributed to “Archived Member.” Your email address and account data are retained so that you may reactivate at any time by signing in again.

Deletion is permanent and cannot be reversed. It removes your email address, name, profile picture, biography, saved list and ratings, and any linked Google, Facebook or Patreon sign-in, and it removes your ability to sign in at all. 

Films you have bought or rented are not lost. They stay linked to the email address used for the purchase, so if you ever create a new account with that same address, they will be restored to it. (Purchases made before 2017, through our previous payment system, are linked to the account itself rather than to an email address and cannot be restored this way.)

If you have an active paid subscription, you will be asked to cancel it before deleting your account. Deleting an account does not by itself stop billing, and we would rather you were not charged for a service you can no longer reach. If you support us through Patreon, your pledge is managed by Patreon and must be cancelled there; we can only unlink it.

Records of payments, contributions to the library (attributed to “Archived Member”), and anonymous view records used to pay filmmakers are retained after deletion as described in our Privacy Policy.


MOBILE APPLICATIONS

Licence. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Films For Action apps on devices you own or control, for your own non-commercial use. You may not copy, modify, reverse-engineer, redistribute, or resell the apps or any part of them, and you may not use them to redistribute, publicly exhibit, or resell access to any film.

Purchases are not made in the apps. Subscriptions, rentals, and purchases are made on our website. Access you buy there is available in the apps at no additional charge.

Third-party content. Most films in the library are hosted and delivered by third parties such as YouTube, Vimeo and the Internet Archive. Playback in the apps uses those providers' players and is subject to their terms. Films may become unavailable, display ads, or stop playing for reasons outside our control, including a rights holder removing them.

Playing on a TV. The apps can send some films to a television using AirPlay, Google Cast, or screen mirroring. This depends on your device, your television, and your network, and it is offered as a convenience without any guarantee that a particular combination will work.

Apple. This agreement is between you and Films For Action, Inc. only, and not with Apple Inc. Apple is not responsible for the iOS app or its content. Apple has no obligation to provide any maintenance or support for the iOS app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Films For Action, Inc., not Apple, is responsible for addressing any claim relating to the app, including product liability claims, any claim that the app fails to conform to a legal requirement, and any claim arising under consumer protection or similar legislation. Films For Action, Inc., not Apple, is responsible for investigating and defending any third-party claim that the app infringes intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.


FILMS FOR ACTION TVOD (PAY PER VIEW) — END USER TERMS

This section covers your purchases and use of TVOD (pay-per-view) content on Films For Action.

Payments

All payments for TVOD content are final and non-refundable, though FFA may issue refunds at its discretion.

Viewing Choices

  • Rent. Pay a one-time fee to stream a video an unlimited number of times during a set time period ("Rental Period"). When that period ends, you no longer have access.
  • Buy. Pay a one-time fee to stream a video indefinitely. Some titles may also include the option to download for permanent storage.

Restrictions

You may only stream or download videos for personal viewing. You may not transmit, distribute, publicly exhibit, or resell access to any video, or allow others to access your account for the purpose of watching a video.

Video Availability

All rental periods will be honored as displayed at the time of purchase. For purchased videos, FFA intends to make content available for streaming indefinitely. However, in rare circumstances — such as a filmmaker requesting removal of their video or a video becoming unavailable for legal reasons — a purchased video may no longer be available for streaming. FFA is not liable in such cases.


FILMS FOR ACTION TVOD — CREATOR TERMS

These terms apply to filmmakers or distributors ("Creator") who sell video content through Films For Action's TVOD (pay-per-view) service. By having your film listed on our platform, you agree to the following terms. These terms are also available on our TVOD Service page.

License Grant. You grant Films For Action a limited, non-exclusive license to distribute your film(s) via our TVOD service. This license is worldwide and continues as long as your film is listed on our platform.

Sale Options. You choose and may modify at any time by notifying us: the purchase options (rent and/or buy), the sale price(s), and the rental duration. The rental period is 14 days by default. Purchases include perpetual streaming access and the ability to download the film in mp4 format by default. The download option can be disabled on request.

Revenue Split. You receive 90% of the revenue from each rental or purchase after Stripe deducts its transaction fee (2.9% + 30 cents). TVOD revenue is transferred to your Stripe account at the time of sale.

Payment Method. You will need a Stripe account to receive payment. You can choose between manual deposits or automatic bank deposits on a daily, weekly, or monthly basis via your Stripe account settings. Automatic/daily is the default. The base currency is US Dollars.

Promotional Rights. You grant FFA the right to use your film's title, poster, trailer, synopsis, and related promotional materials to market your film on the Service and through our social media and newsletter channels. You also grant FFA the right to use your name(s), likeness(es), and biographical material(s), as contained in materials you provide, for the purpose of promoting your film.

Dashboard. FFA will provide a dashboard accessible to you with analytics related to your film's performance and revenue. To access it, you will need a Films For Action account using the same email address used for your Stripe account.

Security. FFA agrees that the server used for streaming is secure and access-protected.

Restrictions. TVOD films are for private, home-use viewing only. FFA will not permit films to be downloaded, reproduced, distributed, or made available in any manner other than as described in these terms.

Removal and Termination. You may request the removal of your film at any time by emailing us. Upon receiving your request, FFA will remove the film from sale within 30 days. FFA may, at its discretion, continue to make the film available to users who previously purchased or rented it, or provide those users with refunds. FFA may also remove a film if it reasonably determines that continued distribution may create legal or regulatory liability.

Taxes. Income taxes on your earnings are solely your responsibility. FFA may file reports with taxing authorities, including the US Internal Revenue Service, as required. Where FFA believes tax collection (e.g., sales tax or VAT) is required on a transaction, FFA may collect and remit such taxes.

Independent Contractors. You and FFA are independent contractors and not partners, joint venturers, or fiduciaries of one another.

Limitation of Liability. Neither party will be liable to the other for any indirect, incidental, special, consequential, or punitive damages arising from this arrangement, even if advised of the possibility of such damages.

Governing Law. These terms are governed by the laws of the State of Kansas. Any disputes will first be resolved through good-faith discussion, and if unsuccessful, through virtual binding arbitration.

Formal Contracts. If you prefer a formal contract, one is available on request. Negotiated agreements supersede any inconsistent terms in this TOS.


FILMS FOR ACTION SVOD (SUBSCRIPTION VIDEO ON DEMAND) — END USER TERMS

This section covers your use of Films For Action's subscription streaming service.

Subscription and Billing

By subscribing, you agree to pay the subscription fee displayed at the time of purchase. Subscriptions renew automatically at the end of each billing cycle unless you cancel before the renewal date.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period, and you'll continue to have access until then. Subscription fees are generally non-refundable. However, if your annual subscription renews and you intended to cancel beforehand, we are happy to offer a full refund if requested within a reasonable timeframe after the renewal charge.

Content Library

The SVOD content library may change at any time. We may add or remove titles without prior notice, and a subscription does not guarantee continued access to any specific title.

Restrictions

Your subscription is for personal streaming only. The same restrictions that apply to TVOD content apply here: you may not transmit, distribute, publicly exhibit, or resell access to any content, or allow others to use your account for the purpose of streaming.

COMMUNITY STANDARDS AND CONDUCT POLICY

Films For Action encourages an open exchange of information, so we allow anyone to create an account and submit content to our library, including videos and articles.

We manually approve all submissions to block spam, but we do not review all submitted content for accuracy or quality. Our Site includes content, information, and opinions from a variety of individuals and organizations other than Films For Action, and the presence of this content does not constitute an endorsement or guarantee of accuracy.

Films For Action is committed to the core principles of honest journalism and ethics (accuracy, transparency, truthfulness, etc). We hold all content added by FFA staff to these standards. Should any errors be pointed out to us or later discovered, we will issue corrections. We also aim to review member submissions as often as we can, and we encourage other members to do the same.

Members can rate content using a thumbs up or thumbs down system. Content that receives more thumbs up ratings will gain greater prominence in our library, while content that receives enough thumbs down ratings from members (or one from FFA staff) may be hidden entirely.

You are responsible for the material you post. By using the Service, you agree not to post or transmit any material that:

  • Is unlawful, threatening, abusive, harassing, defamatory, deceptive, fraudulent, or invasive of another's privacy;
  • Contains explicit or graphic descriptions of sexual acts, or excessive profanity;
  • Victimizes, harasses, degrades, or intimidates an individual or group on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
  • Infringes the rights of others, including copyright, trademark, patent, trade secret, privacy, or publicity rights;
  • Attempts to gain unauthorized access to the Service or any connected system through hacking or other illicit means;
  • Collects personal information from other users for marketing purposes;
  • Impersonates any person or organization, or misrepresents your affiliation with any person or organization;
  • Contains undisclosed advertising, commercial links, or solicitation unrelated to the subject matter of the Service (this will lead to account termination);
  • Contains viruses or code designed to disrupt or damage software, hardware, or networks;
  • Encourages illegal activity or conduct that could cause injury or property damage;
  • Shares your account access with others;
  • Violates these Terms of Service or interferes with others' use of the Service.

FFA may monitor content on the Service and may edit, move, hide, remove, or refuse to post any material for any reason, including violations of these terms or because the material is objectionable or stale. FFA is not liable for any action or inaction regarding content on the Service.


MULTIPLE ACCOUNTS AND RATING CONTENT

Do not create multiple accounts to rate your own submissions, and do not coordinate with others to artificially inflate ratings on your content. We want all ratings to be organic. Users who engage in rating manipulation may have their content hidden or their account banned.


SUBMISSION OF ORIGINAL CONTENT CREATED BY YOU

Original content you submit to Films For Action remains your property. You are solely responsible for your content and the consequences of posting it.

By submitting original work, you grant FFA a worldwide, non-exclusive, royalty-free license to use, display, distribute, and adapt your content as needed to operate the Service and promote your work across any medium. This license is revocable — if you hide or remove your content, the license ends. FFA may retain server copies of hidden or removed content but will not display or distribute them.

Hiding and Removing Content

You may hide submitted content at any time through your account. Hidden content is not accessible to other users or the internet. You may unhide previously hidden content at any time to restore its visibility.


SUBMISSION OF CONTENT NOT CREATED BY YOU

Films For Action allows users to submit videos, articles, and other content created by third parties for inclusion in our library. When you submit content you did not create, you understand that:

  • You are submitting it in good faith, believing it to be freely available for sharing or embedding (e.g., public videos on YouTube or Vimeo, or articles on the open web).
  • You are not uploading copyrighted files to our servers without authorization. Most video content on our Site is embedded from third-party platforms using their standard embed features.
  • FFA does not claim ownership of third-party content and is not responsible for verifying the copyright status of every submission.
  • If a rights holder objects, the content will be removed through our DMCA process described below.
  • You will not knowingly submit content that infringes on the rights of others.

COPYRIGHT COMPLAINTS — DMCA

If you are a copyright owner and believe content on our Site was posted without proper credit or permission, please contact us with your contact information and a link to the content. If the complaint is valid, the content will be removed as soon as possible, or within 72 hours.

Most videos on our Site are embedded from platforms like YouTube and Vimeo using their embed features — we do not host them directly. If you'd like an embedded video removed from our Site, let us know. To address the issue at its source, you'll also need to file a claim with the hosting platform.


REPEAT INFRINGER POLICY

We take copyright seriously and use a three-strikes system:

  • First Infringement: You'll receive a warning via email detailing the issue.
  • Second Infringement: You'll receive a final warning that one more violation will result in account termination.
  • Third Infringement: Your account will be terminated and you will be banned from the service.

An "infringement" occurs when we receive a valid DMCA takedown notice for content on our Site.

Appeals: If your account has been terminated or received a strike, you may submit a counter-notice. If it meets legal requirements and the action was taken in error, we will consider reinstatement.


EXTERNAL LINKS

Our Site links to external websites and resources that are not controlled by FFA. A link does not imply endorsement. We are not responsible for the content, availability, or practices of external sites, and your use of them is at your own risk.


NO SOLICITING

Do not use the Service to advertise or solicit the sale of products or services without our written approval.


TRADEMARKS

Please do not use the Films For Action name, logo, or other materials without our written consent. That said, we encourage people to create local FFA city chapters — if you're interested, contact us. We'd love to support that.


DISCLAIMER OF WARRANTIES AND LIABILITY

We work hard to make Films For Action a great experience, but we can't guarantee perfection.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." FFA DOES NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, COMPLETE, ERROR-FREE, CONTINUOUSLY AVAILABLE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS. YOU USE THE SERVICE AT YOUR OWN RISK.

TO THE FULLEST EXTENT PERMITTED BY LAW, FFA WILL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR INDIRECT DAMAGES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.


INDEMNIFICATION

YOU ARE RESPONSIBLE FOR ALL ACTIVITY UNDER YOUR ACCOUNT. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS FILMS FOR ACTION, INC., ITS OFFICERS, DIRECTORS, VOLUNTEERS, STAFF, AND CONSULTANTS FROM ANY THIRD-PARTY CLAIMS, DAMAGES, OR COSTS (INCLUDING ATTORNEYS' FEES) ARISING FROM YOUR USE OF THE SERVICE, YOUR VIOLATION OF THESE TERMS, OR YOUR INFRINGEMENT OF ANY RIGHTS OF OTHERS.
